1. Purpose and Scope

This DMCA & Copyright Policy explains how Dinka Sports Technology LLC, operating as Dinka ("Dinka," "we," "our," or "us") responds to claims that content available through Dinka’s services infringes copyright. This Policy applies to the Dinka mobile application, the Dinka website, and any related services, features, communications, pages, profiles, posts, photos, videos, messages, club pages, coach pages, event pages, tournament pages, media galleries, or other user-submitted content (collectively, the "Services").

Dinka respects the intellectual property rights of creators, users, coaches, clubs, businesses, and other rights holders. Dinka also respects lawful uses of copyrighted material, including fair use, licensed use, authorized use, and content owned by the user who uploads it.

This Policy is incorporated into Dinka’s Terms of Service. Capitalized terms not defined in this Policy have the meanings given to them in the Terms of Service or Privacy Policy.

2. Ownership of User Content

Users retain ownership of content they upload to Dinka, subject to the license granted to Dinka in the Terms of Service. By uploading content, you represent that you own the content or have the rights, permissions, licenses, and consents necessary to upload it and allow Dinka to host, display, distribute, transmit, store, process, moderate, and otherwise operate the Services with that content.

Uploading content to Dinka does not transfer copyright ownership to Dinka. However, Dinka may remove, restrict, disable access to, or preserve content when required by law, permitted by the Terms of Service, or reasonably necessary to operate or protect the Services.

3. Copyright Complaints Covered by This Policy

This Policy is intended for copyright complaints involving content hosted on or transmitted through Dinka. Examples may include unauthorized use of copyrighted photographs, videos, graphics, written materials, coaching materials, training materials, event media, or other protected works.

This Policy is not the correct process for every type of complaint. For non-copyright issues, please use the appropriate channel:

• Safety, harassment, impersonation, abuse, or prohibited content: use Dinka’s in-app reporting tools or contact support@dinkapickleball.com.

• Privacy concerns: contact support@dinkapickleball.com or review Dinka’s Privacy Policy.

• Trademark, brand, or business impersonation concerns: contact support@dinkapickleball.com with enough detail for Dinka to review the issue.

• Content that violates Dinka’s Community Guidelines but does not involve copyright: report it through the app or contact support@dinkapickleball.com.

4. Designated Copyright Contact

Copyright notices, counter-notices, and copyright-related questions should be sent to Dinka’s copyright contact:

Copyright Contact Dinka Copyright Agent

Email support@dinkapickleball.com
Subject Line DMCA Notice - Dinka Content

Dinka may update this contact information as its legal, operational, or designated-agent registration details change. Notices should be sent in English where possible. Dinka may request additional information if a notice is incomplete, unclear, or does not identify the allegedly infringing material with enough specificity.

5. How to Submit a Copyright Takedown Notice

To request removal or disabling of access to content based on alleged copyright infringement, send a written notice to support@dinkapickleball.com that includes all of the following information:

1. Your full legal name and, if applicable, the name of the copyright owner you represent;

2. Your mailing address, telephone number, and email address;

3. A description of the copyrighted work you claim has been infringed. If multiple works are involved, you may provide a representative list;

4. A description of the material on Dinka that you claim is infringing, including enough information for Dinka to locate it, such as the username, profile, post, comment, message, club page, coach page, event page, tournament page, URL, screenshot, date, or other identifying information;

5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner; and

7. Your physical or electronic signature.

A notice that does not include the required information may delay Dinka’s review or prevent Dinka from taking action. Dinka may forward your notice, including your contact information and statements, to the user who posted the content, to a rights holder, to Dinka’s service providers, or to others as reasonably necessary to process the notice, respond to disputes, preserve records, or comply with law.

6. Dinka’s Response to Copyright Notices

After Dinka receives a copyright notice, Dinka may review the notice for completeness and apparent validity. Where Dinka determines that action is appropriate, Dinka may remove the identified content, disable access to it, restrict its visibility, suspend related features, notify the user who posted the content, or take other action under the Terms of Service and Community Guidelines.

Dinka does not adjudicate copyright ownership disputes and does not provide legal advice to users or rights holders. Dinka may decline to act on notices that are facially incomplete, abusive, fraudulent, unrelated to copyright, or unsupported by enough information to locate the material.

Dinka may preserve copies of removed or disabled content and related account records as reasonably necessary for legal, safety, enforcement, audit, or dispute-resolution purposes, consistent with Dinka’s Privacy Policy and data retention practices.

7. Counter-Notice Process

If your content was removed or disabled because of a copyright notice and you believe the removal was the result of mistake or misidentification, you may submit a counter-notice to support@dinkapickleball.com. Your counter-notice must include:

1. Your full legal name, mailing address, telephone number, and email address;

2. Identification of the content that was removed or disabled and the location where the content appeared before removal or disabling;

3. A statement, under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of mistake or misidentification;

4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, to the jurisdiction of a federal district court where Dinka may be found, and that you will accept service of process from the person who submitted the original notice or that person’s agent; and

5. Your physical or electronic signature.

Dinka may forward your counter-notice, including your contact information and statements, to the person who submitted the original notice. Submitting a counter-notice may have legal consequences. You should not submit a counter-notice unless you understand your rights and obligations.

8. Restoration of Content

After receiving a valid counter-notice, Dinka may restore the removed content or cease disabling access to it in accordance with applicable law, unless Dinka receives notice that the original complainant has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the content at issue.

Dinka may choose not to restore content, or may remove content again, if the content independently violates Dinka’s Terms of Service, Community Guidelines, Trust & Safety Policy, Privacy Policy, or other applicable rules, even if the copyright dispute is resolved or withdrawn.

9. Repeat Infringer Policy

Dinka may suspend or permanently terminate accounts of users who repeatedly infringe copyright or who repeatedly submit content that results in valid copyright complaints. Dinka may consider the number, frequency, severity, credibility, and context of notices; counter-notices; withdrawals; user history; and other relevant information.

Dinka may also limit access to features, remove content, disable media uploads, restrict messaging or posting, or take other enforcement action where appropriate. Attempts to evade copyright enforcement by creating new accounts, using another person’s account, changing usernames, or reposting removed content may result in additional enforcement action.

10. Misrepresentations and Abuse of Process

Copyright notices and counter-notices must be accurate and submitted in good faith. Knowingly submitting false, misleading, or abusive claims may expose the sender to legal liability and may result in Dinka restricting or terminating access to the Services.

Do not use the copyright process to harass users, suppress lawful criticism, remove content you dislike, resolve non-copyright disputes, retaliate against competitors, or manipulate reviews, rankings, sponsorships, or community visibility.

11. Trademarks, Publicity Rights, and Other Intellectual Property

This Policy primarily addresses copyright. Complaints involving trademarks, business names, logos, impersonation, false affiliation, rights of publicity, or other intellectual property concerns may be submitted to support@dinkapickleball.com. Dinka may review and act on those issues under the Terms of Service, Community Guidelines, Trust & Safety Policy, or other applicable policies.

Dinka may remove or restrict content that misleads users about a brand, club, coach, sponsor, tournament, facility, or business relationship, even if the issue does not qualify as copyright infringement.

12. Coaches, Clubs, Sponsors, and Event Media

Coaches, clubs, sponsors, event organizers, and businesses must only upload or distribute content they own or are authorized to use. This includes photos, videos, logos, training materials, advertisements, event flyers, tournament graphics, music, and sponsored media.

Dinka may remove commercial or event-related content if Dinka receives a valid copyright complaint, if the content misrepresents rights ownership, or if the content otherwise violates Dinka’s Terms of Service or Community Guidelines.

13. Records, Privacy, and Disclosure

Dinka may collect, use, retain, and disclose information related to copyright notices, counter-notices, removed content, user accounts, and enforcement decisions as described in Dinka’s Privacy Policy and as reasonably necessary to process copyright claims, operate the Services, prevent abuse, protect rights, comply with law, and resolve disputes.

Because copyright disputes may require communication between Dinka, the complainant, the user who posted the content, service providers, and legal authorities, you should not submit information you are not prepared to have shared as part of the copyright review process.

14. Changes to This Policy

Dinka may update this DMCA & Copyright Policy from time to time to reflect changes in Dinka’s Services, legal requirements, copyright processes, contact information, or operational practices. When required by law, Dinka will provide notice of material changes. Continued use of the Services after an updated Policy becomes effective constitutes acceptance of the updated Policy.
